In OK, the Oklahoma Health Care Authority (OHCA), some state legislators, and a few employees (left over from the Hoffmeister Administration) in the Oklahoma State Department of Education are implementing K-12 SBHC under the guise of expanding school based services.
School based services falls under the federal legal purview of I.D.E.A. and this program only serves children identified as special education and the services are limited to “educationally necessary services” for these students to access classroom instruction and receive a free and appropriate public education(FAPE).
Medically necessary services must be EDUCATIONALLY necessary.
Another word, the State Superintendent of Instruction, OSDE, and OHCA have no legal authority to misuse and and expand this program for low income non-disabled children.
